A rejection under 35 USC 103(a) is a rejection on the grounds that the invention disclosed by the patent application would have been obvious to a person having ordinary skill in the art.

2) 11/329773 (IBM): "Claims 1, 15 are rejected under 35 USC 102(b) as being anticipated by Housley, Cryptographic Message Syntax (published June 1999)."
Housley, "Cryptographic Message Syntax", was submitted by Peer-to-Patent reviewer Rob Cameron.
A rejection under 35 USC 102(b) is a rejection on the grounds that the invention disclosed by the patent application is not novel because it was described in a printed publication more than one year prior to the application date.

Communications of the ACM on Peer-to-Patent

The latest issue of Communications of the ACM has published an article by Andy Oram supporting Peer-to-Patent. The article, Peer to Patent Needs Your Expertise, is one of the February issue's cover stories. In the article, Oram calls upon ACM members to take action:

ACM’s mission calls on its members to lend their expertise to help policymakers and institutions determine the proper role of technology. The U.S. patent system is a particularly apt context for exercising this mandate, because inventors in the computer field live under the constant fear of lawsuits based on patents that should never have been granted in the first place

Oram goes on to explain just why Peer-to-Patent needs the support of people like ACM members:

Peer to Patent should be appealing largely because it’s an immediate intervention with measurable outcomes. Patent applications will not receive the reviews they need until researchers see them as part of their personal responsibility to society, in the same way they spend time refereeing journal papers, sitting on the boards of nonprofit organizations, and performing university-related duties unrelated to their own central research tasks.

Peer-to-Patent at linux.conf.au

Brianna Laugher's wrap up of linux.conf.au on All The Modern Things mentions Peer-to-Patent among other high profile patent challenging initiatives. The conference has grown to become one of the most important technical Linux conferences. It is "run by community volunteers for the community volunteers that have made Linux and Free and Open Source Software the phenomenon it is today."

Noveck in Social Media Today

Social Media Today's Stewart Mader posted a review of Beth Noveck's recent article Wiki-Government. Noveck's article detailed much of the ideology behind Peer-to-Patent, about which Mader agreed:

Experts don’t necessarily know more - they’re perceived to know more. What wikis and blogs have demonstrated is that a lot of people who aren’t recognized as experts have an immense amount of knowledge to offer. It’s true in business, and it’s true in government policy making too.

Mader called Noveck's ideas "the kind of clear, level-headed approach to wiki use that should be taken seriously." He goes on to quote Howard Rheingold:

She’s not just a theorist. Her “peer to patent” project might well succeed in applying collective intelligence to fixing our broken patent system.
